Terms and Conditions for the Social Media Photo Competition

GENERAL CONDITIONS

By entering the #HeartEdFest photo competition on the University of Edinburgh (UoE) Facebook page you are agreeing to the University of Edinburgh storing and using your information for marketing purposes. We will not share your information with third parties and you can opt out at any time by unsubscribing from emails or emailing us directly.  This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. By participating, you hereby release and hold harmless Facebook from any and all liability associated with this promotion. Entrants are providing information to the UoE and not to Facebook. By adding photos to the Facebook competition gallery you are granting permission for these images to be used by the UoE in our website www.ed.ac.uk and other online communications. By submitting your photo you understand and agree that UoE has no obligation to publish your photo. You must be the author/copyright holder of all images submitted. There are 5 weekly contests and 1 overall contest:

 

  • First weekly contest: Open for entries from Friday 22 July 2016 to Thursday 28 July 2016
  • Second weekly contest: Open for entries from Friday 29 July 2016 to Thursday 4 August 2016
  • Third Weekly contest: Open for entries from Friday 05 August 2016 to Thursday 11 August 2016
  • Fourth weekly contest: Open for entries from Friday 12 August 2016 to Thursday 18 August 2016
  • Fifth weekly contest: Open for entries from Friday 19 August 2016 to Thursday 25 August 2016

The deadline for entry to the final-overall contest is Thursday 1 September 2016. All entries submitted throughout the competition period will be considered for this overall contest.  

Please read these competition rules carefully. If you enter one of our competitions, we will assume that you have read these rules and that you agree to them.  

 

ELIGIBILITY:  

1. To enter a competition you must be 18 years old or over at the time of entry.

2. Competitions are not open to employees (or members of their immediate families) of the UoE working for Communications and Marketing or Festivals Office, but it is open to UoE students or members of staff working for teams not identified above.

 

COMPETITION ENTRY REQUIREMENTS  

3. Entries must be posted on Facebook, Twitter or Instagram and must contain the hashtag #HeartEdFest.

4. Entries in Facebook must be uploaded into the competition app.

5. Multiple entries are acceptable from the same person on each weekly contest, only if the entries are different.. No third party entries, bulk entries or entries submitted by agents will be accepted.

6. Incorrectly completed entries will be disqualified.

7. We shall be entitled to disqualify any entry which UoE believes (i) includes any language or visuals deemed abusive, defamatory or indecent; or (ii) otherwise breaches these Terms and Conditions.

8. We cannot be held responsible for entries which are lost or corrupted nor for any entries to the competition which UoE do not receive as a result of any technical error, however caused. In addition UoE cannot accept any liability for any difficulties experienced in submitting an entry. Proof of entry or submission will not be deemed to be proof of receipt.

9. Prior to submitting a photograph of any identifiable individual, entrants should obtain the consent of such person and advise them of the purpose of the submission.

10. Entries submitted to the competition through the Facebook page are in accordance with the following Privacy Policy (www.easypromosapp.com/privacy-policy)

 

SELECTION OF WINNERS

11. Winners for the weekly competition will be selected by a panel of judges. The final winner will be chosen by the panel of judges from amongst all the images submitted throughout the competition period.

12. The criteria used by judging panel to select winners are: (i) number of likes received (ii) originality of the entry (iii) the entry establishes a link between Festivals and the University of Edinburgh, either through the copy or the visual element of the post.

13. We will select the same number of winners as prizes we have available to give out on that particular week. We will also select the same number of runner-ups in case winners choose to forfeit their prizes/fail to claim their prizes in the allocated time.

14. The closing date is as specified in each competition, and UoE reserves the right to amend the competition end date at any time.

15. If you win a competition, we will notify you by e-mail (if you have provided us with it) or over social media if this is the only means of contact. Winners will be notified on the day after the closing date. Winners will be given a link to a Doodle poll so that they put their name against their preferred prize. There will be as many prizes as winners, but this will operate on a first come first serve basis. If you have not put your name against a prize by midnight on the day after the closing date, you forfeit your right to win that competition and we reserve the right to offer the prize to another competition entrant.

 

PRIZES

16. The competition prizes will be specified in the relevant competition, subject to these Terms and Conditions.

17. We will notify you by email or via social media to explain how to claim your prizes.

18. If you fail to claim your prize by the time specified we reserve the right to offer the prize to another competition entrant.

19. No prize or part of a prize is exchangeable for cash, tickets or services.

20. If an advertised prize is not available, we reserve the right to offer an alternative prize.

21. The UoE reserves the right to amend these rules at any time. We may also create rules which will apply to a specific competition only. If we do this we will publish the amended competition rules and/or specific competition rules on the relevant competition page.

 

FINAL DECISION  

22. In all matters, UoE’s decision will be final and no correspondence or discussion shall be entered into with you or any other party on your behalf regarding the process or details of such decision.

 

LIMITATION OF LIABILITY

23. We cannot be held responsible for any costs incurred by you in entering the competition (whether or not such entry is successful) or in relation to you taking part in the competition.

24. For the avoidance of doubt, UoE will not be liable to you, in contract, tort (including, without limitation, negligence) or otherwise in connection with the competition for:

(a) loss of revenues, profits, contracts, business or anticipated savings or loss of data; or

(b) any loss of goodwill or reputation; or

(c) any special or indirect or consequential losses; however caused.

25. We will not be liable for any damages or losses as a result of failure by UoE to deliver any competition, the prize or any other prizes as a result of any circumstances outside of UoE’s direct and reasonable control including, but not limited to, as a result of a server failure (including but not limited to access delays or interruptions, data non-delivery or mis-delivery), any act(s) of God, war or terrorism, breaches of security or unauthorised use of personal data arising from hacking and/or failure or lack of reception of telephone, data, mobile telephone or mobile data networks.

 

YOUR LIABILITY TO US AND YOUR STATUTORY RIGHTS

26. You agree to fully indemnify UoE in respect of all liabilities, damages, claims, actions, expenses (including reasonable legal fees), demands or costs incurred by UoE as a result of any breach by you of these Terms and Conditions.

27. Nothing contained in these Terms and Conditions shall affect any statutory rights to which you may be entitled as a consumer.

 

GOVERNING LAW

28. These Terms and Conditions are governed by and construed in accordance with Scottish law and any dispute arising from them shall be subject to the non-exclusive jurisdiction of the Scottish courts.
