Pre-requisites

This course is only open to visiting students who are nominated to study with us on a Law exchange agreement. Exchange students outside of Law and study abroad students are not eligible to enrol on this course, with no exceptions. Law exchange students who wish to enrol in this course must have completed a course equivalent to Critical Legal Thinking (LAWS08139) or be willing to undertake additional learning in their spare time to catch up on this missing background knowledge during the first few weeks of teaching. **Please see Additional Restrictions**

Course Summary

This course aims to deepen students understanding of law (as a social phenomenon), and improve their argumentative skills, by addressing some theoretical questions about law. These include questions about the relationship between law and morality such as whether we have a moral duty to obey the law (and, if so, why) and whether we need to engage in moral reasoning to determine the content of the law (and, if so, in what ways)? They also typically include questions about the relationship between law and: (i) language (exploring theories of legal interpretation); and (ii) adjudication (including how judges should and, sociologically, how they do, decide cases)

Law exchange students who wish to enrol on this course must usually also enrol in the course Scottish Legal System (LAWS08128) in Semester 1; however, the Course Organiser may waive this co-requisite if satisfied that the student in question has a sufficient level of understanding of relevant parts of this course. **This course is only open to visiting students who are nominated to study with us on a Law exchange agreement.
